TERMS AND CONDITIONS

Welcome to The Lampshade Lady's website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with my privacy policy, govern The Lampshade Lady's relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use this website.
The company tries its best to make sure that all information on the website, including descriptions of products and listed prices are accurate at all times. However, if we do make a mistake we will try to resolve it as soon as possible, and if we spot that an error has affected your order we will do my best to let you know.
All our lampshades are hand-sewn or hand-made to order, taking lots of time and skill. To avoid any disappointment please ensure you order the correct shape, size, fabric, lining, fitting etc. If you require any guidance, please do not hesitate to contact us. All hand-made fabric lampshades, re-covered lampshades or lampshades purchased from The Lampshade Lady are non-refundable / non-returnable as they are all specially made to your order.

Studio (in-person) orders

You will be given a written quotation, please check this before confirming your order. Unless otherwise agreed a deposit of 75% is required at the time of placing the order; once payment has been made the order cannot be cancelled. The balance of 25% is due on collection. Some customers select trimmings after placing an order, the price of such trimmings or any other extras will be added to the balance due at the time of collection.

Online orders

All online sales are final. It is your responsibility to ensure the products ordered are suitable for the use you intend. The Lampshade Lady does not accept liability to replace incorrect or unsuitable orders. Your order counts as an offer to purchase goods from The Lampshade Lady.
-using the lampshade builder: after placing your order, you will receive an Order Acknowledgement email which contains details of the product(s) you have ordered, the total cost of the order including delivery and an order number. You will receive a second email to confirm the estimated delivery date. Prior to work commencing all such orders are paid in full via the online payment methods. Taking payment does not mean we have accepted your order and we reserve the right, at our discretion and without the need to give reasons, not to accept it. If for any reason we are unable to accept your order we will let you know as soon as reasonably possible and provide you with a full refund within 14 days.
-using the bespoke requirements method: all orders made subsequent to acceptance of such quotation are paid in full via electronic transfer to our bank. The company will purchase materials required to complete your order after receipt of payment.

Re-lining and re-covering

We are happy to re-cover and/or re-line your own lampshade / frame(s) and these may be brought / sent to the company in order that we may prepare a quotation.

Lead times

Usually around 6 - 8 weeks but these are subject to variation throughout the year, please enquire at the time of ordering.

Shipping

All products are shipped from the premises at Shottenden Manor Farm, near Ashford in Kent. The prices quoted are for next working-day delivery to most mainland GB destinations (details are available on request).

Fabric samples / stock cuttings

Fabric samples are available on request. There is a £10 charge for the sample service - this is deducted from the cost of the lampshade(s) at the time of ordering. Fabric samples give a good indication of colour but are not guaranteed to be an exact match to the fabric that will be used to make your lampshade(s). If you require a specific match please ask for a stock cutting (this will be cut from the suppliers' existing stock and will be reserved for you for up to 7 days).

Silk

Silk is the most luxurious fibre in the world. The weaving and knitting of silk fabric may contain slubs, uneven threads and other minor variations and irregularities: these are characteristics of fine silk yarn and should not be treated as defects. Care must be taken to ensure silk does not come into contact with liquids as they will leave a stain / watermark. Further some silk qualities and colours may be susceptible to colour leaching if they get wet and abrasion if rubbed against sharp objects. Some shades of silk may be prone to fading after prolonged exposure to sunlight.

Customer’s own material (COM)

If you choose and supply fabric(s) or wallpaper(s) to The Lampshade Lady, for use in your commission(s), this is known as COM. We receive COM on the understanding that it is in new, usable condition, without imperfections or creases and is suitable for use in the making of the lampshade(s) you have commissioned. Should we subsequently discover the COM is damaged or imperfect we will notify you as soon as we become aware of this: we do not accept liability for any such damage or imperfections. If the fabric is or has been folded we will charge for the time taken to iron out the creases / folds to the best of our ability - please be aware some fabrics will remain creased despite our best efforts and it is for this reason we ask that you  / your supplier sends all materials to us on a tube. The company reserves the right to decline to make lampshades using COM if it is not suitable for the lampshade you have commissioned or if it is in an unsuitable condition. The Lampshade Lady does not accept liability for COM being lost or damaged when in transit to us.

Pricing errors

If an incorrect quotation, listing or order confirmation is given at an incorrect price due to a technical, administrative or other reason, we will inform you as soon as possible and you will then be given the option of cancelling your order or re-confirming your order at the correct price. If for any reason we are unable to contact you using the contact details we reserve the right to refuse the order whether or not the order funds are received by electronic transfer, credit or debit card. In this instance the charge will be refunded in the same manner as it was paid.

Damages and returns for distance selling

Because all our products are made to measure to your specific measurements and requirements, they cannot be re-sold and are not subject to the Distance Selling Regulations. It is vital, therefore, that you check the order details before confirming your order as our products are non-returnable. If you receive the wrong product (or goods are missing) the company will endeavour to rectify the issue as soon as possible by sending a replacement (or additional goods). If an item is damaged in transit it will be repaired or replaced if the company has organised the delivery. Please notify the company within three working days of receipt if any goods are damaged, wrong or missing. In the event of damage please help us by providing photographs showing the damage to the packaging (including photographs of the box, inside and outside), the packaging and the damaged item(s) and do not dispose of any of these until we advise you to do so: this is so we can make / process our claim against the couriers. We will advise you if we require you to return damaged goods to us. Refunds will not be authorised in any circumstances.

Damages and returns for items collected from the studio

You will be required to inspect lampshades before taking them from the premises; in the unlikely event there is a defect it must be identified before the lampshade leaves the premises in order than any remedial work can be carried out. No lampshade will be taken from the premises unless it is deemed to be in immaculate and in agreeably acceptable condition (unless it is sold as shop soiled or a sale item). Before leaving the premises the lampshade(s) will be wrapped in protective plastic sheeting or boxed: please ensure the lampshades do not get wet or damaged as we accept no liability for any damage caused when the lampshades have left the premises, whether in transit or thereafter.

Liability

The Lampshade Lady does not accept liability for any loss or damage of any products you (or anyone instructed by you) send to us and recommend all such products are insured and tracked when sent to us.

Storage Fee

Our premises are small and we reserve the right to charge a storage fee of £15.00 per lampshade, per week, for any lampshade whether it was left with us, sent to us or collected by us that we are unable to work on due to the customer’s failure to carry out their obligations within a reasonable time-frame. The storage fee will be applied in situations including but not limited to failure to respond to quotation; failure to make payment (of deposit or in full); failure to supply COM; failure to properly communicate with the company in a timely manner; failure to collect in a timely manner. If the storage fee is not paid the company reserves the right to dispose of the lampshade(s).
